Terms of Service

These terms are an agreement between you and Tolo Labs (“we”, “us”) for all our games and this website (the “Games”). By using the Games you agree to them. Our Privacy Policy explains how we handle your data.
Eligibility and accounts
You must be 13 or older. If you’re under the age of majority, a parent or guardian must agree to these terms. You’re responsible for your account. Guest progress can be lost if you sign out or delete the app without signing in, and we can’t recover it.
Using the Games
We give you a personal, non-transferable, revocable licence to play the Games for non-commercial use. Don’t cheat, exploit bugs, use bots or modified apps, reverse engineer the Games, interfere with our servers, or break the law.
Usernames
Your username is public. Don’t choose one that is offensive, hateful or sexual, that pretends to be someone else (including us), or that breaks someone’s rights. We may reset any username to a random one, or remove it, at our sole discretion and without notice.
Fair play
We decide at our sole discretion whether results and accounts are genuine. We may remove scores, progress or items, and suspend or close accounts, at any time and without notice. Leaderboard positions have no value.
In-game items and purchases
Power-ups and other in-game items are a revocable licence, not property. They have no cash value, can’t be transferred, and are lost without compensation if your account is closed or a game ends. Purchases are made through the App Store or Google Play and are final. Refunds are up to Apple or Google. Remove Ads removes banner and full-screen ads, but optional reward ads may still appear.
Third parties
Ads, app stores, payments and other services in the Games are provided by third parties. We’re not responsible for them or their content.
Our content
The Games, their content, names and logos belong to Tolo Labs. All rights are reserved.
Changes and termination
We may change, suspend or stop any part of the Games, and suspend or close any account, at any time, for any reason, without notice or liability. You can stop playing and delete your account at any time.
No warranties
The Games are provided “as is” and “as available”, without warranties of any kind. We don’t promise they will be uninterrupted or error-free, or that your progress, items or data won’t be lost.
Limitation of liability
To the fullest extent the law allows, Tolo Labs is not liable for any damages of any kind arising from the Games or these terms, including loss of data, progress or items. Your only remedy is to stop using the Games. You agree to indemnify Tolo Labs against claims arising from your use of the Games or breach of these terms.
Where the law doesn’t allow these limits, they apply only as far as it allows, and your non-waivable consumer rights are not affected.
Governing law
These terms are governed by the laws of Ontario and Canada. The courts of Toronto, Ontario have exclusive jurisdiction, unless your local consumer law says otherwise.
Apple
If you got a Game from the App Store, these terms are between you and Tolo Labs, not Apple. Apple has no responsibility for the Game, its support or any claims about it, beyond refunding the price if it fails a warranty. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
General
We may update these terms. They take effect when posted, and continuing to play means you accept them. If any part is unenforceable, the rest still applies. These terms and our Privacy Policy are the whole agreement between us.
